Makeup Service Agreement & Contract

The following represents an agreement between Toby Wesenberg – Makeup Artist (herein referred to as the “MUA”) and clients who wish to book my makeup services for their wedding or event date. Agreeing to this contract signifies the client's approval to have Toby Wesenberg - Makeup Artist execute makeup services as outlined in a separate quote provided. The quote (estimate) document will be converted to an invoice upon agreement of this contract. Services and event dates are not guaranteed until a 50% non-refundable/non-transferable retainer is provided - this amount will be invoiced to the client upon the client's completion and submission of this agreement.

Terms & Policies

Payments

A non-refundable, non-transferable retainer of 50% of the total cost of services (excluding the bridal makeup trial) is due upon the signing of this contract, in order to secure your date and time. This amount, once paid, is deducted from the total owing.

The remaining balance is due in full 7 days prior to your event date as one payment – no exceptions.                                                                       

The cost of the bridal trial is invoiced separately from the "day of" booking, and is to be paid at the time of the trial booking, and is non-refundable, non-transferable and cannot be applied towards the grand total of the "day of" booking.

Gratuity is not included in the total on your estimate or invoice.

Once this contract is signed, the client may not reduce services requested. Should the client wish to add services, this must be requested in writing, upon agreement of both the client and the MUA, and an updated invoice will be provided to the client, making any previous invoices null and void.

Payments can be made by etransfer to tobywesenberg@gmail.com, by cash, or by money order/bank draft only. No cheques or credit cards accepted.

The client agrees to pay the final balance plus any additional service fees incurred during the planning process, no later than one week prior to the event date listed in the below form.

Failure to provide payment as outlined may result in service cancellation without refund and use of third party collections.

 

Date Changes/Availability

Toby Wesenberg - Makeup Artist does not guarantee availability for date changes. If available, all deposits and payments will be transferred to the revised date. If unavailable, deposits are considered non-refundable and non-transferable. In these circumstances, the below cancellation policy applies.

 

Cancellation

The client agrees to notify the MUA, in writing, of any decision to cancel. THE CLIENT WILL BE RESPONSIBLE FOR THE FULL AMOUNT OF SERVICES AGREED UPON IN THIS CONTRACT FOR ANY CANCELLATIONS MADE WITHIN 60 DAYS OF THE EVENT DATE. Failure to provide payment as outlined WILL result in the use of third party collections.

 

Service Provision Requirements

In order to provide services, the MUA requires:

  • A table & work area at the location of services, which must be well-lit with sufficient lighting by lamps or natural light.
  • Uninterrupted parking, within two city blocks of the makeup application location, at the client’s expense.
  • In a booking of 5 -7 people, the MUA requires one 20 minute break.
  • Depending on the client's schedule for her wedding day, the MUA may hire one or more assistants, upon discussion with the client. The hiring of any assistants necessitates an additional fee, to be provided in a quote to the client in advance.

In order to ensure a pleasant and organized experience that allows for the proper sanitation of all tools in between clients, the following timelines must be adhered to:

  • Bridal makeup: 1.5 hrs
  • Each bridal party member: 1 hr

Based on the above timelines, if the client’s schedule requires that the MUA depart their originating address prior to 7am in order to accommodate the schedule, a flat fee of $100 will be applied to the total owing.

It is essential that clients and their bridal parties adhere to the agreed schedule. For every 15 minutes the MUA waits for a client/bridal party member, the client will be charged $25. No refund will be given for members of the wedding party who miss their appointment on the day of the event.

 

Abuse Clause

The MUA treats all clients with the utmost respect, and the MUA asks that clients and all members of their wedding party do the same. At no time and under no circumstances whatsoever shall the MUA tolerate abusive, violent, destructive, menacing, or harassing behaviour from the client or any party acting on behalf of the client. If such behaviour does occur, the MUA will quietly and respectfully inform the client and/or party members to handle the situation. If, however, the abusive behaviour does not stop, the MUA will consider it a breach of contract, and vacate from the premises immediately without providing any further services. Any remaining fees will be due immediately and on the spot, regardless of further services not commenced and without refund of any monies paid.

 

Photography Rights

The MUA has the right, at its sole cost and expense, to photograph and/or video record any pre-event looks. Any and all photographs and videos made or created by the MUA at the event shall be the property of the MUA, and may be used and published by the MUA in connection with its business and the operation and promotion of the MUA.

 

Impossibility

The performance of this contract is subject to any circumstance making it illegal or impossible to provide or use the MUA’s services, including without limitation, acts of God, war, government regulations, disaster, civil disorder, or curtailment of transportation infrastructure or facilities, or other circumstances reasonably beyond the control of the parties. The contract may be terminated only for any of the above reasons by written notice from either the MUA or the client to the other. Under these circumstances, if the client decides not to reschedule their event booking, the MUA will refund by etransfer any monies paid by the client, minus the non-refundable/non-transferable retainer.
